TERMS AND CONDITIONS

General Terms and Conditions (GTC) for orders via www.kosa-store.com

In the following we would like to present our General Terms and Conditions, which we use as a basis for the processing and handling of your purchase. At www.kosa-store.com, we offer you a personalised shopping and service experience tailored to your interests and needs. On www.kosa-store.com we sell KOSA partner articles.

KOSA partner articles are articles that we offer you on www.kosa-store.com and identify as partner articles by means of a notice.

1. CONCLUSION OF CONTRACT AND DELIVERY OF GOODS

1.1 We conclude contracts via www.kosa-store.com exclusively in German. When ordering KOSA partner articles, your contractual partner is KOSA-Store, Jacquingasse 16, 1030 Vienna, and additionally the respective KOSA partner, whose identity we will inform you about individually on the respective product detail page.

1.2 By clicking the "Buy" button, you place a binding order for the items in the shopping basket. We will confirm receipt of your order by email immediately after you have sent the order.

1.3 We will deliver your order within Austria. If working days are specified as deadlines, we understand this to mean all days from Monday to Friday inclusive, with the exception of public holidays.

2. PRICES, SHIPPING COSTS AND EXPRESS DELIVERY

2.1 The prices listed in the offer at the time of the order shall apply. The prices stated are final prices (gross prices), i.e. they include the statutory value added tax applicable at the time. Until the purchase price has been paid in full, the goods remain our property or the property of the partner of the KOSA partner articles.

2.2 We will pay the shipping costs, except for express shipping, from an amount individually determined by KOSA Store. We reserve the right to determine this amount and to change it.

2.3 We offer the option of express delivery for certain orders. You can see whether this option is offered for your respective order and the costs incurred for this in the order process. The goods will be delivered within 3 working days at the latest. If this delivery time is exceeded, you will be refunded the delivery costs.

2.4 Different delivery charges may apply to the dispatch of particularly bulky, heavy or valuable items, which we will state individually for each product on the product detail page and on the order page during the sale.

3. PAYMENT

3.1 We generally offer credit card and Paypal as payment methods. For each order, we reserve the right not to offer certain payment methods and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). Any costs of a money transaction are to be borne by you.

3.2 In the case of a credit card purchase, your credit card account will be charged when we dispatch your order.

3.3 You agree to receive invoices, credit notes and reminders in electronic or paper form.

4. PROMOTION VOUCHERS AND THEIR REDEMPTION

4.1 Promotional Vouchers are vouchers which cannot be purchased but which we issue as part of promotional campaigns with a specific period of validity. Promotional Vouchers are therefore purely promotional measures.

4.2 Promotional vouchers can only be redeemed during the specified period and only once as part of an order transaction. Individual brands may be excluded from the voucher promotion. Promotional vouchers cannot be used for the purchase of gift vouchers. Please note that promotional vouchers may be subject to a minimum order value.

4.3 The value of the goods must be at least equal to the amount of the promotional voucher. A difference to a higher value of goods can be compensated with the offered payment options. The value of a promotional voucher is neither paid out in cash nor does it earn interest. The promotional voucher will not be refunded if goods are returned in whole or in part.

4.4 Promotion vouchers can only be redeemed before the order process is completed. Subsequent crediting is not possible. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined unless we have agreed otherwise.

4.5 If you have used a promotional voucher when making your purchase, we reserve the right to charge you the original price of the goods you are keeping if - due to your cancellation - the total value of the order falls below the respective value of the promotional voucher.

5. LEGAL RIGHT OF WITHDRAWAL FOR KOSA-PARTNER ITEMS

YOU HAVE A LEGAL RIGHT OF REVOCATION FOR THE PURCHASE OF KOSA-PARTNER-ARTICLES:

We would like to inform you in advance that in the event that you wish to return goods, you may use the returns label enclosed with your order. If you need a new returns label, you can also request one from our Customer Care department (contact details below). Please help us to avoid unnecessary costs and do not return the goods without a returns label.

CANCELLATION POLICY:

You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods or, in the case of partial deliveries, the last delivery. To exercise your right of withdrawal, you must inform KOSA-Store, Jacquingasse 16, 1030 Vienna, +43 660 6464006, e-mail: office@kosa-store.at of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter or e-mail sent by post) or verbally (for example by telephone). You can use the attached model cancellation form for this purpose. However, this is not mandatory. To comply with the cancellation period, it is sufficient for you to send the notification of the exercise of the right of cancellation before the end of the cancellation period.

Consequences of the revocation

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which the notification of your withdrawal from this contract is received by us or our partner. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the end of the period of fourteen days. We will bear the costs of returning the goods if you use the return label provided by us for a return initiated within Austria. Otherwise, the return costs are to be borne by you. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

End of the cancellation policy

Attention: The right of withdrawal expires prematurely for contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Furthermore, you do not have the right of cancellation for contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the customer is decisive or which are clearly tailored to the personal needs of the customer.

6. REPAYMENTS

We will automatically arrange for any repayments to be made to the account used by you for payment. If you have paid by instant bank transfer, the refund will be directed to the account from which the transfer was made. If you have paid by Paypal or credit card, the refund will be made to the associated Paypal or credit card account.

8.1 Your warranty rights are subject to the statutory provisions.

8.2 The use of the services available on www.kosa-store.com is only allowed for persons who are at least 18 years old.

8.3 Each customer is only entitled to maintain one customer account with KOSA Store at the same time. We reserve the right to delete multiple registrations.

8.4 You can view these GTC at www.kosa-store.com. In addition, you can print or save this document by using the usual function of your internet utility (=browser: there usually "File" -> "Save as").

8.5 You can also additionally simply archive the GTC as well as the data of your order by either downloading the GTC and saving the data summarised on the last page of the order process in the Internet shop using the functions of your browser or you wait for the automatic order confirmation which we will additionally send to you by e-mail after completion of your order to the e-mail address you have provided. This order confirmation e-mail once again contains the data of your order and our General Terms and Conditions and can easily be printed out or saved with your e-mail programme.

8.6 The European Commission provides a platform for online dispute resolution (OS), which you can find under the link to the platform of the European Commission . We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
